NO CHARGES FOR FELONY-LEVEL ALLEGATIONS OF RECEIVING STOLEN PROPERTY

The client was arrested for an unrelated traffic matter and was informed by police that charges for receiving stolen property would be presented to the Grand Jury. After the client informed Attorney Brad Wolfe of the facts of what actually occurred, Brad contacted the detective on the case and provided exonerating evidence which resulted in no additional charges.

DISMISSAL OF DOMESTIC VIOLENCE CHARGE AND REDUCTION OF ASSAULT CHARGE TO MINOR MISDEMEANOR

The client was charged with domestic violence and assault, each a misdemeanor of the first degree. After facilitating various mitigative efforts, as well as identifying potential shortcomings of the accuser’s statements, the government agreed to dismiss the domestic violence charge and reduce the assault to a minor misdemeanor infraction of disorderly conduct. The sentence was a monetary fine and the entire case will be eligible for sealing in one year.

NO CHARGES FOR ALLEGATIONS OF SEXUAL ASSAULT

The client was contacted by law enforcement regarding multiple allegations of sexual assault, which he adamantly denied. Attorney Brad Wolfe facilitated an independent investigation and arranged a meeting with the detective on the case to discuss additional and exonerating information. No charges were filed, and the investigation was closed.

FELONY DRUG AND GUN CHARGES REDUCED WITH POTENTIAL FOR FULL DISMISSAL

The client was charged with multiple, felony firearms offenses as well as the trafficking and possession of Schedule I drugs. Attorney Brad Wolfe negotiated a plea deal in which the client pleaded to low-level felonies which will be entirely dismissed upon the client’s completion of an intervention program.

HIGH-TIER OVI (.201 BAC) REDUCED TO PHYSICAL CONTROL

The client was pulled over for weaving and observed by police to have multiple, empty beer bottles on the passenger-side floorboard. Following successful plea negotiations and the identification of potential suppression issues, Attorney Brad Wolfe negotiated a plea deal in which the client pleaded No Contest to physical control and avoided jail time. The administrative license suspension was also vacated in this case as a result of various statutory violations.

DISMISSAL OF THEFT CASE

The client was accused of stealing money from the Home Depot while employed with the company. Attorney Brad Wolfe negotiated a resolution with the company’s in-house counsel and convinced the prosecutor to allow the client to enter a diversion program. After 3 months of attending the diversion program, the case was dismissed completely and has been sealed from the public record.

DISMISSAL OF FELONY DRUG CASE

The client was charged with numerous traffic offenses as well as the possession of illegal narcotics. After reviewing the details of the case with the prosecutor, the government ultimately decided that the elements of the offenses would likely not be met. The case was dismissed.

Bedford Municipal Court

TERMINATION OF FEDERAL PROBATION

The client was previously convicted of conspiracy to distribute a controlled substance and sentenced to 3 years of federal probation. After serving less than half of the sentence, Attorney Brad Wolfe successfully petitioned for the termination of the client’s supervision. The client was able to maintain and grow his new businesses because of the termination.

United States District Court for the Northern District of Ohio

NO JAIL FOR 11TH THEFT OFFENSE

The client had stolen several items from Walmart of relatively low value. The offense, however, was the client’s 11th theft charge in 15 years, and, the client had previously spent 2 years in prison. Although the prosecutor was advocating for the maximum jail time of 6 months, the court adopted Attorney Brad Wolfe’s request for a sentence of house arrest and a fine.

DISMISSAL OF DRUG-RELATED PROBATION VIOLATION

The client was on probation for a felony-level drug offense and submitted a routine urine sample which tested positive for heroin. The client was adamant that he had not used any drugs but that he had consumed numerous poppy seed bagels in the days prior to the urine test, which can trigger a false-positive. Attorney Wolfe presented the results of independent hair follicle testing, various academic research articles, and even verification of the client’s grocery purchases to the judge which resulted in a complete dismissal of the alleged violation.

DISMISSAL OF FOUR, SEPARATE UNDERAGE CASINO CASES

The client was accused of using a fake ID to enter a casino and was charged in four individual, but related, criminal cases. Attorney Brad Wolfe negotiated with the prosecutor to permit the client to enter a diversion program. After 3 months of attending the diversion program the cases were dismissed completely and have been sealed from the public record.

NO JAIL FOR PROBATION VIOLATION

The client was previously convicted of operating a vehicle under the influence of alcohol. As a term of his sentence, the court ordered him to complete a driver’s intervention program, which did not occur. The probation department issued a warrant for the client’s arrest and advocated for him to serve jail time. Attorney Brad Wolfe facilitated the client’s completion of the class and successfully argued to the court against the imposition of any further jail.

TRAFFIC OFFENSE AMENDED TO AVOID SUSPENSION OF LICENSE

The client had previously pleaded guilty to a traffic offense in Ohio which had severe ramifications in her home state including the potential loss of her license. Attorney Brad Wolfe successfully moved to withdraw the plea and negotiated an amended zero-point violation which enabled the client to keep her license.
