If a non-mandatory sentence is less than two (2) years, then the applicant may file for Judicial Release immediately after arriving at a state correctional institution.
If a non-mandatory sentence is at least two (2) years, but less than five (5) years, then the applicant may file for Judicial Release no sooner than serving six (6) months of the sentence.
If a non-mandatory sentence is five (5) years, then the applicant may file for Judicial Release no sooner than serving four (4) years of the sentence.
If a non-mandatory sentence is at least five (5) years, but ten (10) years or less, then the applicant may file for Judicial Release no sooner than serving five (5) years of the sentence.
If a non-mandatory sentence is more than ten (10) years, then the applicant may file for Judicial Release no sooner than serving one-half of the sentence.
